Terms and Conditions of Sale and Delivery for Pre-Launch Access
1. General
These terms and conditions (“Terms”) apply to purchases of access to Micromojo’s LoveGame App via our website www.micromojo.com. By completing the purchase, you agree to these Terms.
2. Purchase Conditions
• Access can only be purchased through our official purchase process on our website.• The access applies to a beta version of the app.
• The purchase includes access to a closed beta area online, which may be under ongoing development.
• The purchase is personal and may not be transferred to others without written permission from Micromojo ApS.
3. Platform Requirements
• Our app is currently only compatible with iOS devices.
• The user is responsible for ensuring that their device is compatible with our app.
4. Age Requirement
• You must be at least 18 years old to purchase and use our service.
5. Payment and Delivery
• Payment is made in advance at the time of purchase.
• After purchase, you will receive immediate access to our closed beta area.
• As this is a digital product, the right of withdrawal is waived pursuant to the Danish Consumer Agreement Act, §18, section 2, no. 13.
• By purchasing, you expressly agree that delivery begins immediately and that your right of withdrawal is thereby forfeited.
6. Beta Access and Disclaimer
• Beta access is offered with a launch discount and may be subject to bugs, limitations, and delays.
• We reserve the right to modify, update, or postpone delivery without prior notice.
7. User Responsibility
• Our service offers recommendations and inspiration. These are not substitutes for couples therapy, medical advice, or any professional guidance.
• The service is not suitable for people with mental health issues or individuals in severely problematic relationships.
• Users are solely responsible for assessing the applicability of our suggestions and for their own implementation.
• The service is intended only for people in stable relationships and with normal mental capacity.
8. Limitation of Liability
• Micromojo cannot be held liable for direct or indirect damages, data loss, operational loss, or any other losses related to the use of our app or services.
• We disclaim all liability for:
o Device malfunctions on the user's equipment
o Data loss on the user's device
o Emotional or relational consequences of using the app
o Errors, bugs, or delays in beta access
o Any damages resulting from user actions based on our suggestions
• The service is provided "as is" and without any guarantees of improvement in relationships, emotions, or personal outcomes.
9. Disputes and Governing Law
• Any dispute between the user and Micromojo ApS shall be governed by Danish law and settled by the ordinary courts in Denmark.
10. Changes to the Terms
• We reserve the right to update and amend these Terms at any time. The applicable version will always be available on our website.
11. VAT and Taxes
11.1 General
All prices on our website are listed in Danish Kroner (DKK) and include VAT unless clearly stated otherwise. As this is a digital service, we handle VAT in accordance with applicable international rules.
11.2 Sales to Consumers (B2C)
• For customers in Denmark, Danish VAT (25%) is applied.
• For customers in other EU countries, VAT is applied based on the customer's country of residence, under the OSS scheme.
• For customers outside the EU, including the USA, UK, Norway, etc., we do not charge VAT unless local legislation requires it.
• For Norway, VAT is handled under the VOEC scheme. For Japan and some other countries, local taxes may apply depending on applicable regulations.
11.3 Customer Responsibility for Non-EU Purchases
• For purchases from non-EU countries, the customer is responsible for paying any applicable local taxes, duties, or import fees related to accessing or using our services in their region.
12. Data Protection and Cookies
By purchasing and using our service, you agree to our Privacy Policy and Cookie Policy, which describe how we process your personal data and use cookies to enhance your experience. We process data in compliance with the EU General Data Protection Regulation (GDPR).
